Hello, friends. I'm a trial attorney licensed in Florida since 2003. My office is in Fort Lauderdale. Since approximately February of 2010, my work has been dedicated primarily to representing homeowners in foreclosure litigation, not only in Broward, Miami-Dade and Palm Beach Counties, but throughout most of the state. Law, and more specifically going to court for the "little people" against the entrenched, wealthy, and corrupt is not simply my job, it is a major component of my personal identity. I LOVE what I do! (Being an HONEST lawyer, I have to mention I like making money for doing it, too. Shhhh!)
Speaking of LOVE, I don't have much for the banks, their "servicers," or (with a few notable exceptions) the attorneys who represent them. I am, in contrast, decidedly fond of of the old-fashioned idea that people must (gasp!) actually speak the TRUTH in court. Imagine that.
Here's another way in which I differ from our opponents in this fight: Unlike almost all financial institutions in existence, I have not the slightest difficulty stating my complete legal name. It is, and will always be, Kenneth Eric Trent. That would be me to the left. I'm pleased to meet ya! :-)

I was drawn into this vitally important area of law in the course of representing clients, the Browns, in a single foreclosure case brought by David J. Stern and his firm (now apparently dissolved). That case, my first foreclosure defense, ended favorably for my clients in or about May of 2010 after I identified a fraudulent assignment of mortgage, which led to revelations about thousands of other fraudulent and forged documents being filed by foreclosure-mill law firms both in Florida and elsewhere. That "Assignment of Mortgage" was one hell of a document - - in a life overflowing with legal documents, that is one sheet of paper I will never forget. That's it at the top of this page. It was a door into the secret universe of MERS, and an eye-opener of epochal magnitude. That document was not the problem, it was a symptom. Of what, you ask? A major and highly contagious D I S E A S E. Make no mistake, my friends, . . . "THE EPIDEMIC IS INDEED NATIONWIDE."
It is GREAT to be a meaningful part of the team trying to control and ultimately eradicate this affliction! I am proud that I was able to play a key role in exposing the "Robo-Signers" and their near- metaphysical corporate progenitor, ~~MERS~~ . That company, if one can even call it that, was and is the primary innovation used to implement the massive criminal conspiracy of subprime lending and wholesale securitization of mortgage loans from which the Nation continues to suffer through the present time. As a fundamental component of the plan, MERS was designated as "nominee" in some 62 million subprime mortgages between 2005-2009.
As an American, and as a true believer in American constitutional justice, including equal rights under the law, I would like to shut it down.
As part of my efforts, I filed and continue to pursue wholeheartedly a class action against David J. Stern, his law firm, MERS, and some 22 financial institutions which are the "key" shareholders in MERS. It is called Figueroa v. MERSCORP, Inc., et al., and I filed it in the U.S. District Court in and for the Southern District of Florida on July 26, 2010. The original version of the Complaint is posted below. I amended it shortly after it was filed to include some 22 original shareholders in MERS, including Fannie Mae, Freddie Mac, Wells Fargo, Bank of America, Sun Trust, and JPMorgan Chase & Co. The original Complaint is posted below. It is one of the first, if not THE first, legal filings to specifically describe the MERS conspiracy, including the use of fraudulent, "robo-signed" documents.
Through times and events which are surreal, we maintain our appeal by keepin' it real.
Incredibly, the case has been dismissed, and we are now appealing. The district court judge decided that we are complaining about injuries "caused by" the state court final judgments of foreclosure entered against the class members. In reality, the injuries are "caused by" the MERS criminal conspiracy, and the final judgments of foreclosure are not the "cause," but instead are the MEANS through which the conspirators accomplish one of their goals. As I argued in the appeal, the Apollo XIII moon landing illustrates this principle. The spacecraft is like the judgments - - it was not the "cause" of the moon landing; instead, it was the means by which President Kennedy's plan to put a man on the moon was accomplished. The "cause" was Kennedy's plan. Our brief has been filed, and I believe it is persuasive and legally correct. Although some may see my persistence as Quixotic, I remain determined and optimistic.
